CRL Rights Commission Files Criminal Charges Against Freedom of Religion SA’s Michael Swain

The CRL (Cultural, Religious, and Linguistic) Rights Commission has laid criminal charges against Michael Swain, executive director of Freedom of Religion South Africa (FOR SA), following allegations of defamation against commission chairperson Thoko Mkhwanazi-Xaluva.

Allegations of Misinformation

Mkhwanazi-Xaluva claims that FOR SA falsely accused her of receiving R1.5 million from the National Lotteries Commission (NLC) for the Cheryl Zondi Foundation while serving as the commission’s chairperson. The accusations, she says, are part of a smear campaign as the CRL prepares to implement regulations for faith-based organizations.

Cheryl Zondi Denies Funding Claims

Cheryl Zondi, founder of the Cheryl Zondi Foundation and a prominent advocate for survivors of religious abuse, has vehemently denied receiving any NLC funding. Speaking to Aldrin Sampear, Zondi clarified that her foundation operates solely on her personal funds and donations, with no financial support from the NLC.

“These rumors are baseless and unfounded,” Zondi said. “We never applied for NLC funding, and they don’t even have our banking details.”

She explained that the only interaction with the NLC was through a partnership with another organization, Ezimo 447 NPC, which received R1.5 million for awareness campaigns. The Cheryl Zondi Foundation’s involvement was limited to receiving donated T-shirts, banners, and a gazebo—not monetary support.

Legal Action and Call for Accountability

Zondi expressed frustration over the spread of misinformation, particularly given Swain’s legal background and large audience. She is pursuing a civil case against FOR SA, hoping to set a precedent against defamation.

“People must fact-check before spreading lies,” she said. “There should be consequences for those who damage reputations with false claims.”

Reflections on Justice and Faith

Zondi, who gained national attention after testifying in a high-profile abuse case involving a pastor, also spoke about her foundation’s mission to support survivors of abuse in religious settings. Despite the legal setbacks in her own case, she remains committed to advocacy.

“I know I spoke the truth,” she said. “Even if the justice system failed us, we stopped [the accused] from harming others for eight years—that’s a victory.”

She also addressed her personal faith, stating that her relationship with God remains strong despite the challenges. “I’ve disassociated God from those who misrepresent Him,” she said.
