A call for the release on bail of 12 men linked to a deadly shooting incident is growing in Mmasebudule village, outside Lehurutshe, amid claims from residents that the arrested individuals were actually appointed to protect the community.
The men, aged between 21 and 48, were tracked down and arrested after a team of detectives was established to investigate a fatal confrontation between security officers and alleged illegal miners, known as zama zamas. They face a series of serious charges including murder, attempted murder, kidnapping, robbery, and malicious damage to property. The Zeerust Magistrate’s Court has remanded the case until 6 October.
However, residents of Mmasebudule village are questioning the arrests. They contend that the 12 men are not perpetrators but were instead security officials appointed by tribal council leaders to protect villagers from lawlessness and illegal mining activities.
Echoing the community’s sentiment, a legal representative for the suspects has strongly advocated for their release on bail.
“Let’s just get them out on bail. My priority is to get my clients out on bail. That’s my first priority,” the attorney said. “Then the state must finalize the investigation so that we can get access to the docket and set the trial date. We’ve, I think we’ve got an excellent case.”
The legal representative described the detention of the suspects as a “travesty” and a “miscarriage of justice,” while acknowledging that navigating the legal process is necessary. “Unfortunately, I can’t go into the details at this point in time, but I think it’s a travesty that these people are in jail,” the attorney added.
The matter is scheduled to return to the Zeerust Magistrate’s Court on 6 October for a bail application. Until then, the 12 suspects will remain in custody.
