In a significant legal victory for Zimbabwean immigrants, the Zimbabwe Immigration Federation (ZIF) has successfully defended an interim court order preventing the arrest and deportation of Zimbabwe Exemption Permit (ZEP) holders. The Department of Home Affairs had sought to overturn the interdict but was rebuffed by the courts, providing relief to thousands of permit holders.
The ruling reaffirms protections for ZEP holders, ensuring they remain legally recognized in South Africa while awaiting the outcome of a broader legal challenge. Benjamin Kenichi, chairperson of the ZIF, hailed the decision as a crucial safeguard against arbitrary arrests and forced deportations.
Background and Legal Battle
The ZEP regime was introduced in 2009 to regularize the status of Zimbabweans fleeing economic and political turmoil. Currently, an estimated 180,000 permit holders face uncertainty after the government announced plans to terminate the program.
The ZIF’s case is split into two parts:

Part B, yet to be heard, will challenge the minister’s authority to revoke permits without parliamentary oversight, arguing that long-term ZEP holders have accrued constitutional rights.

With the Supreme Court of Appeal’s dismissal of Home Affairs’ challenge, the ZIF will now proceed with Part B of its case, seeking a permanent resolution on the permits’ validity.
“This is a victory for due process and the rights of legal immigrants,” Kenichi stated, urging authorities to respect the court’s decision.
